Terms of Service

1. Introduction

Welcome to BEYND. These Terms of Service ("Terms") govern your access to and use of the BEYND platform, websites and services (the "Service"), operated by BEYND AI Ltd. ("BEYND", "we", "us").

By creating an account, signing an order form or accessing the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Service

BEYND provides a voice-intelligence platform that ingests customer conversations, produces real-time transcription, sentiment analysis, summaries, coaching prompts and integrates with third-party systems such as CRMs, dialers and ticketing tools.

We continuously improve the Service. We may add, modify or remove features. Where a change would materially diminish a paid feature, we will give reasonable advance notice.

3. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised access.

You must be at least 18 years old and authorised to act on behalf of the organisation you represent.

4. Acceptable Use

You agree not to use the Service to record conversations without all required consents under applicable law; upload content that infringes third-party rights or violates law; reverse-engineer, decompile or attempt to extract source code from the Service; use the Service to build a competing product; or interfere with or disrupt the integrity of the Service.

5. Customer Data

Ownership. Customer Data remains your property. You grant BEYND a limited license to process Customer Data solely to provide the Service.

Use. We do not use your Customer Data to train models that benefit other customers unless you explicitly opt in.

Data residency. Customer Data is stored in the region selected on your order form (EU, US, or IL).

6. Pricing & Billing

Subscription fees are described in your order form. Fees are billed in advance, are non-refundable except as required by law, and are exclusive of taxes.

We may revise pricing for renewal terms with at least 30 days notice prior to the renewal date.

7. Intellectual Property

BEYND retains all rights, title and interest in and to the Service, including underlying software, models, documentation and brand assets. You are granted a limited, non-exclusive, non-transferable right to use the Service during the subscription term.

8. Limitation of Liability

To the maximum extent permitted by law, neither party's aggregate liability arising out of these Terms will exceed the fees paid by you to BEYND in the 12 months preceding the event giving rise to the claim. Neither party will be liable for indirect, incidental, consequential, special or punitive damages.

9. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. Disputes will be brought exclusively in the courts of Tel Aviv-Yafo.
